Clear Ketamine Therapy ("we," "our," or "us") operates the website clearketaminetherapy.com (the "Site") and provides physician-supervised ketamine therapy in the Tampa Bay area of Florida. This Privacy Policy explains how we collect, use, disclose, and safeguard information collected through this website.

This Privacy Policy covers information collected through the Site. It does not replace our Notice of Privacy Practices, which governs how we handle Protected Health Information (PHI) as a healthcare provider under the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and its implementing regulations at 45 CFR Parts 160 and 164. Where this policy and our Notice of Privacy Practices differ on the handling of PHI, the Notice of Privacy Practices controls.

We collect as little as we can. Our consultation form asks for your name, how you would like to be reached, and a general sense of what you are looking for — it does not ask for diagnoses, symptoms, medications, or medical records. We never sell your information. We do not run advertising or retargeting pixels on this site.

If you do choose to tell us something about your health — in the form's open-ended option, by email, or on the phone — we treat that information as Protected Health Information and handle it under HIPAA. We do not pretend otherwise, and we do not use it for marketing.

Information you provide voluntarily. When you submit the consultation form, we collect your name, your preferred contact method, and the phone number or email address you give us, along with a non-clinical category describing what brings you to us (for example, "just learning about ketamine therapy" or "ready to schedule a consultation"). The form requires your consent to be contacted before it can be submitted.

Information collected automatically. Our web server records standard technical request data, including IP address, browser type, and the pages requested. This is used to operate and secure the site.

Site analytics. Analytics are disabled by default on this site and run only if we deliberately enable them. When enabled, they are configured to receive aggregate page-view data only — never form field values, free text, or health information. The vendor list further down this page reflects exactly what is configured right now, generated from the site's configuration file rather than written by hand.

We are a healthcare provider. That means information which identifies you and relates to your physical or mental health, your care, or payment for that care is Protected Health Information under HIPAA once it is in our hands — regardless of whether it reached us through a form, an email, a phone call, or an office visit.

We have deliberately designed the consultation form so that it does not ask you to disclose a diagnosis or condition in order to contact us. The reason categories are about intent, not clinical status. This is a design choice made to minimize the health information collected through a public web form, consistent with the HIPAA minimum-necessary principle.

If you volunteer health information anyway — because you chose the open-ended option, replied to an email, or told us on the phone — we do not discard our obligations or claim it is not PHI. We treat it as PHI: it is limited to the staff who need it to respond to you, it is not used for advertising or marketing, it is never sold, and it is handled under our Notice of Privacy Practices.

We still ask you not to send diagnoses, medication lists, or medical records through the website form or ordinary email. Not because we would treat them casually, but because unencrypted email and public web forms are not the most secure route available. Clinical details are better shared by phone or during your consultation.

This section exists to state plainly which legal frameworks govern our operations and how we meet them.

HIPAA (45 CFR Parts 160, 162, and 164). As a covered healthcare provider, we comply with the HIPAA Privacy Rule, Security Rule, and Breach Notification Rule. We maintain administrative, physical, and technical safeguards for PHI; we limit uses and disclosures to the minimum necessary; we obtain written authorization before any use or disclosure not otherwise permitted by law; and we provide patients the individual rights described in our Notice of Privacy Practices.

Business Associate Agreements. Any vendor that creates, receives, maintains, or transmits PHI on our behalf — including hosting, form-intake, scheduling, and communications providers — is engaged under a written Business Associate Agreement as required by 45 CFR 164.502(e) and 164.308(b). We do not route PHI through vendors that will not sign one.

Florida Information Protection Act (Fla. Stat. § 501.171). We comply with Florida's breach notification requirements, including notice to affected individuals within 30 days of determining that a breach of personal information has occurred, and notice to the Florida Department of Legal Affairs where the statute requires it.

Florida medical records and confidentiality law. We comply with Florida Statutes § 456.057 governing the confidentiality and release of patient medical records, and with Florida's telehealth requirements at § 456.47 where care is delivered remotely.

Mental health and substance use protections. Because ketamine therapy is frequently sought for psychiatric indications, records may attract heightened protection — including HIPAA's separate treatment of psychotherapy notes, the confidentiality provisions of Florida Statutes Chapter 394, and, where applicable, the federal substance use disorder confidentiality regulations at 42 CFR Part 2.

Section 1557 of the Affordable Care Act. We do not discriminate on the basis of race, color, national origin, sex, age, or disability, and we provide language assistance and accessible communication on request.

Controlled substance and telehealth prescribing rules. Ketamine is a Schedule III controlled substance. Prescribing and administration records are maintained in accordance with the Controlled Substances Act, DEA regulations, and Florida law, including reporting to Florida's Prescription Drug Monitoring Program (E-FORCSE) where required.

We use the information we collect only for the purposes below.

We do not sell, rent, or trade your personal information or your health information. We share it only in these limited circumstances:

All traffic to and from this website is encrypted in transit using TLS. Information you submit through the consultation form is never written to public logs, never sold, and never shared with advertisers, and access is limited to the staff who need it in order to respond to you.

No method of transmission over the internet or method of electronic storage is completely secure. We use commercially reasonable safeguards appropriate to the sensitivity of the information, but no system can promise absolute security — which is precisely why we ask you to keep clinical detail off public web forms and unencrypted email.

This site does not require tracking cookies to function, and we do not set advertising or retargeting cookies. We do not run session-replay tools, and we do not build marketing profiles from your visit.

Because there is no industry-standard interpretation of browser "Do Not Track" signals, this site does not respond to them differently — there is no cross-site tracking here to turn off.

If this ever changes, this policy will be updated before the change goes live, and the vendor list below will name the vendor and state exactly what it receives.

Your rights over your Protected Health Information — including the right to access your records, request an amendment, request an accounting of disclosures, request restrictions, request confidential communications, and be notified of a breach — are described in detail in our Notice of Privacy Practices.

For information collected through this website that is not PHI, you may ask us what we hold about you, ask us to correct it, or ask us to delete it. We will respond as promptly as we can, subject to any legal retention obligations that apply to healthcare records.

You may also file a complaint with us or with the U.S. Department of Health and Human Services, Office for Civil Rights, at hhs.gov/hipaa/filing-a-complaint or (800) 368-1019. We will not retaliate against you for filing a complaint.

Clear Ketamine Therapy provides care to adults aged 18 and older. This website and our consultation form are intended for adults. We do not knowingly collect personal information from anyone under 18 — if you believe such information has been submitted through this site, contact us and we will delete it.

This site links to external resources such as clinical research, government health agencies, and crisis services. We are not responsible for the privacy practices of those sites, and we encourage you to read their policies.

We may update this policy to reflect changes in our practices or in the law. When we do, the effective date at the top of this page changes and the updated policy is posted here. Significant changes will be described in plain language, the same way the rest of this policy is written.
